Terms of Service

Business service and acceptance

GarageOS is a business-to-business shop-management service operated by Mitchell Jeussef Castellanos Fuentes, a sole proprietor carrying on business as GABAN Solutions (“GarageOS”, “we”). GABAN Solutions is a business name, not a separate legal entity. By creating or using an account on behalf of a shop, you represent that you are authorized to bind that business to these Terms. Service

GarageOS supports shop workflows such as customers and vehicles, appointments, estimates and approvals, work orders, inspections, invoicing, payments, communications, reminders, tire storage, reporting and other features made available under the selected plan. Features may evolve, and beta or future features are not promised for a particular date.

Plans, trial and billing

Current plan pricing is shown on our pricing page. Unless stated otherwise, prices are in Canadian dollars and applicable taxes are additional. New eligible accounts may receive the 14-day free trial shown at signup. When a payment method is collected, the first charge date and amount are shown before the trial begins. Monthly plans renew monthly; annual plans are billed upfront for the annual term. Subscriptions renew unless cancelled in accordance with the cancellation controls made available by GarageOS.

Usage charges

Some services with direct usage costs, including SMS, may have included allowances and overage charges disclosed in the product or at purchase. The shop is responsible for charges generated by authorized account activity. GarageOS does not activate unannounced add-on charges.

Failed payments, restriction and cancellation

If payment fails, GarageOS may retry collection and may temporarily restrict access after any applicable grace period while preserving the account data as described in our retention practices. Cancellation normally takes effect at the end of the paid subscription period unless the product clearly states otherwise. Amounts already paid are non-refundable except where required by law or expressly agreed by GarageOS.

Shop responsibilities and electronic messages

The shop is responsible for the legality and accuracy of information it enters, the users it authorizes, and the messages it sends through GarageOS. The shop must have any consent or other authority required to contact its customers, must respect opt-outs and applicable anti-spam requirements, and must not use GarageOS for unlawful, deceptive, abusive or unsolicited messaging.

Customer data

As between GarageOS and the shop, the shop retains its rights in the business and customer data it submits. The shop authorizes GarageOS and its service providers to host, process, transmit, back up and otherwise handle that data as necessary to provide, secure and support the service and as described in our Privacy Policy. The shop represents that it has the authority necessary to provide the data to GarageOS.

Security and accounts

You must protect account credentials and promptly notify GarageOS of suspected unauthorized access. Shop owners are responsible for users they invite and permissions they grant. GarageOS may suspend access when reasonably necessary to protect the service, customers or data, investigate abuse, comply with law or address material breaches of these Terms.

Third-party services

GarageOS may integrate with third-party services such as payment, accounting, email and SMS providers. Third-party services may have their own terms and availability. GarageOS is not responsible for a third party's independent service, outage or policy, but remains responsible for its own obligations regarding personal information it handles.

Availability and warranty

We work to keep GarageOS reliable and secure, but no online service is uninterrupted or error-free. To the extent permitted by applicable law, GarageOS is provided on an “as is” and “as available” basis without warranties not expressly stated in these Terms.

Liability

To the extent permitted by applicable law, neither party is liable to the other for indirect, incidental, special or consequential damages arising from the service. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited. Any more specific written agreement signed by GarageOS and the shop controls to the extent of a conflict with these Terms.

Termination and data

After termination or cancellation, access may end when the applicable subscription period ends. Shops should export data they need before access ends. GarageOS may retain or delete information in accordance with its Privacy Policy, retention practices and legal obligations.

Changes

We may update these Terms as the service or applicable requirements change. Material changes will be communicated or presented as appropriate before they apply. Continued use after an applicable effective date constitutes acceptance where permitted by law.
